I thought that it's kind of crazy for her to go through a whole sex change just for a baby because they could of easily adopted or had a surrogate. Doing this changed her whole life. Since they did not have evidence which gender he was at the time of their marriage, they aren't allowed to be divorced. I believe that as long as the formal couple has proof of some sort of a marriage certificate, it should be legal. I think it gets really confusing between what is same sex marriage and what is not when it comes to transgenders. A person's sex is defined by their reproductive organs, so I guess technically it is a same sex marriage but I don't think those types of marriages should be banned. I think that people should be who they want to be and marry who they want to marry. I think it's not possible to change sex, but it is possible to change gender. I feel really bad for the children because they must feel really confused as to why their parents can't be married. I'm not too sure about the facts and I can see why the judge is confused as well. I do remember this case a while ago and my mother talking about it. I actually think that my mom knows him, her. I remember seeing this couple on the cover of a magazine when Thomas was pregnant with their first child... I had no clue there are three now! I dont know what to say about the trial and judge. Im sure the judge is confused with the lack of information. If they wanted a fair case, they should have laid out all facts for the judge to process. I do not consider the marriage to be same sex but the pregnancy obviously shows Thomas is still a "woman". The judge cannot prove she was a woman in Hawaii, but she was a woman after that, therefore she was always a woman. He should be treated the way he wants to be treated, as a man. I dont think it is possible to change--genetically to the opposite gender. Women will produce eggs and men will produce sperm. That is that. We can alter our looks, our voices and attitudes to change what we want to be. I don't think the court should see this marriage as a same sex marriage. Try we're married when Thomas was legally a male, and honestly he hasn't been a female in a long time. I think since he and his wife were legally married not as a same sex couple the court should not view them as a same sex couple. While I definitely believe that when someone changes their identity and is a transgender I think they can completely change their gender. That is how they are viewed and feel. However, their sex can't really truly changed because although Thomas may not have any of the genitalia associated with being female he still has two X chromosomes. I feel bad for the kids in this situation. But then I realized he was actually a women first and then wanted to become a man. Overall I thought this was a very confusing article...I think the judge should charge this as a same sex marriage because she was technically still a women when they got married and had children. However, I think a fully completed transgender person would be able to marry someone of the same original sex. I think the only way to know for sure if he was a she when they got married is to research and actually find when she started taking pills or get the surgery. I think if this women wanted to become a man, he should be treated as the man he is today and not as his past. I do not understand how this man wants a divorce when he was never really married. I also do not understand why this couple or union can't go back to Hawaii to divorce? Divorce is a difficult topic, and I feel that if children is involved, divorce is never a good idea. I feel bad for the three children who must be already be going through a hard time, and this divorce would not help anything. I also feel that changing genders is a bad idea. Overall, I feel that the decision to deny the divorce is a good idea. I think that because America is a country of freedom, that everyone in every state should be granted the choice of marrying whoever they want to, regardless of the gender. I had to re-read some parts more than once in order to understand what the article was saying about the couples marital status. I think that the judge should treat the case as a same sex marriage because at the time of their marriage in 2003, Thomas had already completed reconstruction therapy and testosterone treatments. I guess the judge could claim Thomas was a girl because he still had his feminine genitalia at the time of their marriage. I think that because Thomas is comfortable being a male, he should be seen as the man that he is.
